The United States Sentencing Guideline Amendments

It is that time again…  the United States Sentencing Guideline Amendments take effect in less than a month. They go into effect  on November 1, 2024. 

​ Key amendments include:

  1. Acquitted Conduct: Relevant conduct (§ 1B1.1) now excludes conduct for which a defendant was acquitted from being considered in sentencing unless it establishes the offense of conviction. 
  2. Calculating Loss: Clarifies that loss is the greater of actual or intended loss, ensuring consistent application across circuits and rejecting the Third Circuit’s defendant friendly decision in US v. Banks. 
  3. Circuit Conflicts: Resolves conflicts regarding 

    a. firearm serial number legibility ​ ( if firearm had an altered or obliterated serial number or a serial number that was modified such that the original information is rendered illegible or unrecognizable to the unaided eye – increase by 2 levels); 

    b. and grouping of certain counts in sentencing.

  4. Youthful Individuals: Allows for downward departures in sentencing for youthful offenders, recognizing cognitive development and potential for rehabilitation. (§ 5H1.1)
  5. Miscellaneous: Addresses various issues, including export control violations, monetary transaction offenses, antitrust offenses, and enhanced penalties for drug offenses.
  6. Technical: Makes non-substantive changes for clarity and consistency.
