Should I Talk to the Police Without an Attorney?

Many of our clients were approached by federal law enforcement agents prior to retaining us.  When the federal government is investigating a potential criminal matter, and before formal charges are brought, agents frequently will contact the person and ask them to come in to talk.   These individuals are not arrested – they are not forced to go  “down to the station” or to have these officers in their homes or workplaces.  Rather, these are law enforcement agencies who are seeking to speak to these individuals on a voluntary basis.   People frequently ask us whether they should speak to the agents or the Assistant United States Attorney without an attorney.  They want to know why they should not speak to them if they did not do anything wrong.  Here is our answer – Do not do it!!!  You should never speak to any law enforcement officer who approaches you to speak with them without an attorney.

There are so many reasons why you should not do this — some are pretty evident. In fact, you see some of them on television shows and documentaries  frequently.  The police or agents have their idea about who committed the crime they are investigating – and it is you!   Police can put a lot of pressure on someone they are questioning or  interrogating. And despite how rough their questioning seems to be – or how long it goes on for – courts have upheld these investigative tactics in many situations.  We have all heard of “false confessions.”   You may think that you are too smart for that – and it would never happen to you.  But the question is this —  why would you take the chance in the first place?
