LGR LAW OBTAINS IMPRESSIVE VARIANCE IN DRUG CASE INVOLVING FENTYNAL

On April 21, 2023 LGR Law won a substantial victory for a client in a drug conspiracy charging several individuals with possession with intent to distribute fentanyl.  As part of a negotiated plea, the government sought career offender Guidelines, which would have placed him at a sentencing range between 151 – 188 months in prison.  Without career offender Guidelines, he faced a potential sentence of between 70 -87 months in prison.   At the sentencing hearing, the Government requested a non-career offender Guidelines sentence (70-87 months in prison).

LGR Law sought a substantial variance, based upon mitigating factors that set this client apart from his codefendants.  While ultimately seeking a sentencing between 24 and 30 months, the Court  determined first that he was not a career offender, then granted a  variance  down to 36 months (34 months below the lowest  non-career offender Guideline range). The Court relied on many of the arguments set forth in LGR Law’s sentencing submission, as well as the client’s statements at sentencing.
